Agreement to Terms

Welcome to imok. These Terms of Service ("Terms") govern your access to and use of the imok mobile application and related services (collectively, the "Service"), operated by imok ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Description of Service

imok is a personal safety check-in application designed to help users maintain regular contact with their designated emergency contacts. The Service allows users to:

  • Set up daily check-in reminders
  • Designate emergency contacts to be notified if check-ins are missed
  • Track check-in history and streaks
  • Access premium features through paid subscriptions

Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

User Responsibilities

When using our Service, you agree to:

  • Use the Service only for lawful purposes
  • Obtain consent from individuals before adding them as emergency contacts
  • Not use the Service to harass, abuse, or harm others
  • Not attempt to gain unauthorized access to the Service or related systems
  • Not interfere with or disrupt the Service

Emergency Contact Notifications

The Service is designed to notify your designated emergency contacts when you miss a check-in. By using this feature, you acknowledge and agree that:

  • Notifications may be sent via SMS, email, or other communication methods
  • You must obtain explicit consent from each emergency contact before adding their phone number. By adding a contact's phone number, you confirm that the contact has agreed to receive SMS alerts from imok on your behalf
  • Emergency contacts may opt out of SMS at any time by replying STOP to any message. You should inform your contacts of this option
  • We cannot guarantee delivery of notifications
  • The Service is not a substitute for emergency services (911)

Premium Subscriptions and Payments

Some features of the Service require a paid subscription ("Premium"). By subscribing to Premium:

  • You authorize us to charge your chosen payment method through our payment processor, Dodo Payments
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You can cancel your subscription at any time through the app settings
  • Refunds are handled in accordance with our refund policy and applicable laws

Pricing and Billing

Subscription prices are displayed in the app before purchase. Prices may change, but any changes will not affect active subscription periods. All payments are processed securely through Dodo Payments.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We offer refunds in accordance with applicable consumer protection laws. Contact [email protected] for refund requests.

Intellectual Property

The Service and its original content, features, and functionality are owned by imok and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

  • Any warranty that the Service will be uninterrupted, secure, or error-free
  • Any warranty regarding the accuracy or reliability of notifications
  • Any warranty that the Service will meet your specific requirements

IMPORTANT: imok is NOT a replacement for emergency services. In case of an actual emergency, always contact your local emergency services (911) directly.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Failure or delay in delivering notifications
  • Any other matter relating to the Service

Indemnification

You agree to defend, indemnify, and hold harmless imok and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account data (except as required by law)
  • Provisions that should survive termination will remain in effect

You may delete your account at any time through the app settings or by contacting support.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
